Following the end of the transition period on 31st December 2020 the UK became a ‘Third Country’ in respect of data protection.
Regardless of whether the UK is granted “adequacy status or not you will be required to appoint an EU Representative if you:
- Do not have an establishment in the EU, and
- Offer goods or services to data subjects in the EU, or
- Monitor behaviour of data subjects in the EU (such as using cookies on a website)
You will be required to designated in writing a representative in the EU.

As the Trade and Cooperation Agreement created a “level playing field” organisations in the EU will be required to appoint a representative in the UK in similar circumstances. Green CDL Ltd can act as your UK representative.
